1. Citation

These Rules may be cited as the Children and Young Persons (Approved Schools) (Annual Holiday) Rules.

2. Manager may give permission to go on holiday

The manager of an approved school may subject to these Rules permit any child or young person who is detained in an approved school to go on annual holiday to such place within Mainland Tanzania as the manager may specify for a period not exceeding fourteen days (exclusive of the time, if any, necessarily spent in travelling).

3. Restriction of grant of privilege

The grant of the privilege of an annual holiday shall extend only to those children and young persons who have been detained in the approved school for a period exceeding one year and who have been of good behaviour to the satisfaction of the superintendent of the approved school.

4. Superintendent shall be in charge

During the period of the annual holiday and whilst travelling to and from the place where the holiday is spent, the children and young persons shall be in the charge of the superintendent of the approved school or such other person as the manager may appoint and the superintendent or such other person, as the case may be, shall be responsible for their proper supervision.

5. Legal custody

Every child and young person to whom the privilege of annual holiday is granted shall be deemed to be in legal custody during the period of the holiday and while travelling to and from the place where the holiday is spent and shall be subject, so far as is practicable and within the discretion of the person in charge, to the discipline, rules and regulations in force at the approved school in the same manner as if he had not gone on annual holiday.

6. Serious misbehaviour

In the event of serious misbehaviour whilst on the annual holiday or while travelling to the place where the holiday is to be spent the person in charge may cause the offender to be sent back to the approved school forthwith under escort.

7. Escape from legal custody

If any child or young person to whom the privilege of an annual holiday has been granted escapes from lawful custody he may be apprehended without warrant by any administrative officer or police officer, or by any person authorised by either of such officers, and sent back under escort to the approved school.
