1.

These Regulations may be cited as the Arms and Ammunition (Safe Custody) Regulations.

2.

Any person who—
(a)while carrying a firearm is under the influence of alcohol or drugs to such an extent as to be incapable of having proper control of that firearm;
(b)leaves any firearm or ammunition in an unattended vehicle, aircraft or vessel;
(c)permits a person under the age of fourteen years to have any firearm or ammunition in his custody, control or possession;
(d)leaves any firearm or ammunition unattended without having first removed such part or parts as may be necessary to render the said firearm incapable of immediate use;
(e)stores any ammunition together with the firearm therefor;
(f)leaves a shotgun, rifle, pistol or revolver in any place or premises which are not reasonably secure against theft,
shall be guilty of an offence against these Regulations and under the provisions of section 31 of the Arms and Ammunition Act 1 and shall on conviction—1Cap. 223
(i)be liable to imprisonment for a term not exceeding twelve months or to a fine not exceeding four thousand shillings or to both;
(ii)if he holds a licence or permit under the Arms and Ammunition Act be further liable to forfeiture of his licence or permit or to suspension thereof for such period as the court thinks fit; and
(iii)be liable to have all arms and ammunition in respect of which an offence is committed forfeited.

(1)It shall be lawful for any person to deposit with the officer in charge of any police station described in the Schedule hereto any licensed firearm or ammunition on such terms and conditions as the said police officer may direct.
(2)It shall be lawful for any such police officer or any police officer under his immediate supervision to possess for any period any firearm or ammunition deposited with him in accordance with the preceding paragraph notwithstanding that such firearm or ammunition has been left with him for a period longer than the period for which it is deposited.
