Local Lotteries Regulations, 1968

1. Citation

These Regulations may be cited as the Local Lotteries Regulations.

2. Interpretation

In these Regulations, unless the context otherwise requires—"local lottery" means a lottery other than a foreign lottery;"private lottery" or "private ticket lottery" means a lottery or ticket lottery, as the case may be, in which only such class of persons as are specified in the permit issued in respect thereof are allowed to participate;"public lottery" or "public ticket lottery" means a lottery or ticket lottery, as the case may be, in which any member of the public may participate;"society" means a society registered under the Societies Act1 or any other organisation or body of persons which the Director may approve for the purposes of these Regulations;1Cap. 337"ticket lottery" means a lottery in which two or more persons are invited to purchase lottery tickets bearing different numbers, which numbers are subsequently drawn and the holder of the ticket bearing the winning number is declared to be the winner of the prize in the lottery.

3. Application for permit

Every application for a permit to promote a lottery shall be in the form set out in the First Schedule to these Regulations.

4. Fees

There shall be paid in respect of every permit to promote a lottery the appropriate fee prescribed in the Second Schedule to these Regulations.

5. Forms of permit

Every permit for a lottery shall be in the form set out in the Third Schedule to these Regulations.

6. Public lottery to be promoted by society

A public lottery shall not be promoted save by a society.

7. Terms and conditions of permit for public lottery

Every permit to promote a public ticket lottery shall be subject to the following terms and conditions—
(a)the proceeds of sale of the tickets after deducting therefrom the total value of the prizes payable out of such proceeds and the expenses reasonably incurred in connection with the promotion of the lottery shall be paid to such charity or charities as the Director may approve;
(b)no ticket shall be sold to any person under the apparent age of eighteen years;
(c)the price of a ticket shall not exceed four shillings;
(d)tickets shall be issued in booklets each containing such number of tickets as the promoter may decide and there shall be attached to every ticket a counterfoil on which there shall be entered by the person selling the ticket the name and address of the purchaser of the ticket;
(e)there shall be printed on every ticket—
(i)the serial number;
(ii)the price of the ticket; and
(iii)the date of the draw;
(f)there shall be printed on the reverse of every ticket information relating to—
(i)the closing date on which the sale of tickets for the lottery shall cease; and
(ii)the manner in which prizes may be claimed;
(g)the number of tickets which may be issued free of charge shall not exceed one-tenth of the total number of tickets sold;
(h)no ticket shall be sold after the closing date;
(i)the draw shall be held at the time and place stated on the ticket, except that the promoter may, for sufficient cause, postpone a draw;
(j)every draw shall be supervised by a person nominated by the Director in that behalf;
(k)the results of every draw giving a list of the numbers of the tickets which have won prizes shall be advertised at least once in a newspaper circulating within the Tanzania;
(l)where the holder of a ticket which has won any prize fails to claim the prize within six months from the date of the draw, the prize shall form part of the proceeds of sale of tickets and shall be disposed of accordingly;
(m)in the event of any dispute between the promoter and the holder of any ticket, the dispute shall be referred to the Director whose decision shall be final and binding upon the person;
(n)the promoter shall, within six months of the closing date, furnish the Director with audited accounts in respect of the lottery;
(o)such other terms and conditions as the Director may specify in the permit.

8. Terms and conditions of permit for private lottery

Every permit to promote a private ticket lottery shall be subject to the following terms and conditions—
(a)the sale of tickets shall be restricted to such class of persons as may be specified in the permit;
(b)the price of a ticket shall not exceed four shillings;
(c)the sale of tickets shall be restricted to the premises or to the area as may be specified in the permit;
(d)such other terms and conditions as the Director may specify in the permit.

9. Terms and conditions of a permit other than a ticket lottery

Every permit to promote a lottery other than a ticket lottery shall be subject to the following terms and conditions—
(a)the lottery shall be held within such premises or area as may be specified in the permit;
(b)only such class of person shall participate in the lottery as may be specified in the permit;
(c)such other terms and conditions as the Director may specify in the permit.
