1.

These Rules may be cited as the Plant Protection (Control of Uganda Strain of Cassava Mosaic Disease) Rules.

In these Rules, unless the context otherwise requires—"cassava" means and includes any part of the cassava plant other than the roots

The transportation of cassava plants from or into any part of the Administrative Region of Kagera without a written permission of the Director of Agriculture is hereby prohibited.

4.

(1)The District Agriculture and Livestock Development Officer or the officer for the time being responsible for agriculture in a District in which the Uganda strain of cassava mosaic disease has been found or is suspected to be present, shall declare that district to be under quarantine.
(2)The transportation of any cassava plant out of any area which has been declared under subrule (1) of this rule, to be under quarantine is hereby prohibited.

(1)Any inspector who finds or reasonably suspects the presence of Ugandan strain of cassava mosaic disease on cassava plant growing on any land shall—
(a)notify the fact to the owner or occupier of the land; and
(b)direct the owner or occupier of the land to uproot and destroy by fire, the cassava plant growing on the land.
(2)No inspector shall order destruction of cassava roots which can be peeled and used for food.

6.

(1)No person shall plant or cause to be planted in any field in the quarantine area cassava seed other than that which is proven resistant to the Ugandan strain of cassava mosaic disease, and distributed by agricultural extension officers.
(2)Any inspector who finds on any land—
(a)cassava plants being planted; or
(b)upon which has been planted with cassava seed, which is not or he reasonably suspects not to be resistant to Uganda strain of cassava mosaic disease,
shall direct the owner or any person in occupation of the land, to uproot and destroy the cassava plant by fire.

7.

Any person who—
(a)contravenes any provision of this rule; or
(b)refuses, fails or neglects to comply with any directive of an inspector given pursuant to these rules; or
(c)obstructs any inspector on the execution of his duties; or
(d)in any way interferes in the implementation of any provisions of these rules,
is guilty of an offence and is liable to a fine not exceeding twenty thousand shillings or to imprisonment for a period not exceeding six months or to such fine and imprisonment.
