Government Notice 89 of 2013

Part I – Preliminary provisions

1. Citation

These Regulations may be cited as the National Security Council Regulations, 2013.

2. Applica­tion

These Regulations shall apply in relation to meetings and procedures of the Council, Regional Security Committees and District Security Committees.

3. Interpreta­tion

In these Regulations, unless the context otherwise requires:"Act" means the National Security Council Act;"Committee" means Committees referred to in Regulation 12;"Coordinator" means the Coordinator of Council referred to in Section 6 of the Act;"Council" means the National Security Council established by Section 4 of the Act;"Security Committee" means the Regional Security Committee or District Security Committee;"Security organs" means the Tanzania Peoples’ Defense Forces, the Police Force and the Tanzania Intelligence and Security Service.[Cap. 61]

Part II – Meetings of the National Security Council, Regional and District Security Committees

(a) – The National Security Council

4. Notice of meeting

(1)The Secretary shall, except in emergency, issue a notice in writing for meetings of the Council to members and to any person who the Council seeks to co-opt at least five days prior to the date on which the meeting is to be held.
(2)The notice of the meeting shall, except for the copy to be sent to the co-opted person, be attached with the agenda and all documents which the Council seeks to deliberate upon.

5. Agenda for meetings of the Council

(1)Agenda for meetings of the Council shall be prepared by the Secretariat in such a manner as would allow members to understand and appreciate the subject matter of discussion.
(2)In preparing agenda for the meeting, the Secretariat shall collect and analyze all information on the national security, defense or emergency that poses state of alert or threat to the national interest, peace or tranquility furnished by the Security Organs, Immigration Services, Prisons, the Disaster Relief Co-ordination Unit, public institutions and private institutions and the general public and make recommendations on how to deal with or respond to the threat.

6. Meetings of the Council

(1)The Council shall meet once in every two months and at any such time as may be necessary and expedient for the transaction of its business.
(2)Notwithstanding sub-regulation (1), the Chairman may direct the Council to meet in order to evaluate any matter of national security, defense or emergency for purposes of countering or responding to a short or long term threat against national interest, peace and, or tranquility.
(3)There shall be no representation of membership at the meetings of the Council.

7. Minutes of the Council

Minutes of each meeting of the Council shall be kept in proper form by the Secretariat and shall be confirmed by the Council at the subsequent meeting and signed by the Chairman and the Secretary of the Council.

8. Direction of the Council

All orders, notices or directions issued by the Council shall be issued or signed by the Chairman or the Secretary.

(b) – Regional and District Security Committees

9. Notice of meetings

The Regional Administrative Secretary or as the case may be, the District Administrative Secretary shall, except in emergency, issue a notice in writing for meetings of the Regional Security Committee and District Security Committee respectively, to members and to any person who is co-opted at least three days prior to the date on which the meeting is to be held.

10. Meetings of Regional and District Security Committee

(1)The Regional Security Committee and the District Security, Committee shall meet once in every month and at such time as may be necessary and expedient for the transaction of their business.
(2)Notwithstanding sub-regulation (1), the Chairman of the Regional Security Committee or the District Security Committee, as the case may be, may direct the meeting to be held in order to evaluate any matter of state of security for purposes of countering or responding to a short or long term threat against peace and, or tranquility.
(3)Except for a person acting in the capacity of the holder of such relevant office or title, there shall be no representation of membership at the meetings of the Regional Security Committee or the District Security Committee.

11. Agenda for meetings of Regional District Security Com­mittees

(1)Agenda for meetings of the Regional Security Committee and the District Security Committee shall be prepared by the Regional Security Secretariat or the District Security Secretariat as the case may be.
(2)The agenda shall be prepared in such a manner as would allow members to understand and appreciate the subject matter of the discussion.
(3)In preparing agenda for the meeting the Secretariat shall collect, collate and analyze all information on security matters that pose threat to peace and, or tranquility in their geographical jurisdictions.
(4)The Regional Security Officer or the District Security Officer, as the case may be, shall compose a Secretariat whose members shall not exceed three.
(5)The Regional Security Officer or the District Security Officer shall keep custody of records and all documents of the Regional Security Committee or as the case may be the District Security Committee.

Part III – Committees of the Council

12. Commit­tees

There shall be two types of committees of the Council as follows:
(a)A Permanent Committee which shall consist of:
(i)the Chief of Defense Forces;
(ii)the Inspector General of Police;
(iii)the Director General of the Tanzania Intelligence and Security Service; and
(b)Ad hoc Committees which shall consist of such categories of persons as may be necessary for the purpose of carrying on any assignment given to the committee.

13. Functions of the Permanent Committee and ad hoc Committee

(1)The Permanent Committee shall coordinate strategies to facilitate interaction among state security organs and sharing of information on all matters that pose threat to national security and shall, in that respect, provide the Council with all the data and information necessary for the Council to adequately deliberate on the threat and make an informed decision on an appropriate course of action.
(2)The Permanent Committee shall prepare a report on every activity undertaken by security organs in implementation of the decision or directive of the Council and shall submit the report to the Coordinator at any time as the circumstances may require.
(3)An ad hoc committee formed pursuant to paragraph (b) of Regulation 12 shall undertake such tasks as may be contained in Terms of Reference stipulated by the Council, and shall prepare a report on every activity so assigned toit and submit such report to the Coordinator.

Part IV – Information and reporting requirements

14. Supply of information on security matters

(1)The Council, the Regional Security Committee and the District Security Committee may, as the case may be, for the purposes of analysis and evaluation of the state of national security, co-ordination Of security matters and response against natural disasters, demand the disclosure or supply of information by an individual person, a public officer, public or private institution or a civil organization.
(2)Where a demand for disclosure or supply of information is made, in pursuance to sub-regulation (1), an individual, public officer, public or private institution or anybody or body of persons shall be under obligation to disclose or supply such information.

15. Reporting on security matters

(1)Every Regional Security Committee and District Security Committee shall, in writing, prepare a report on security matters discussed by the meeting of every such security committee within their geographical jurisdictions and submit such report to the immediate higher security committee.
(2)The report shall contain such information on any matter or event that poses threat to peace and, or tranquility and any recommendation on how the threat has been, or may be mitigated, averted or removed.
(3)For the purposes of the preceding provisions of this Regulation, a report of every security committee shall be submitted to the immediate higher security committee in the following sequence:
(a)in the case of the Regional Security Committee, not later than the 10th day of every calendar month; and
(b)in the case of the District Security Committee, not later than the 5th day of every calendar month.

16. Directives by District Security Com­mittee

The District Security Committee may issue directives to the Ward Executive Officer, Mtaa or Village Executive Officer, in the case of Mainland Tanzania, or Sheha, in case of Tanzania Zanzibar, for supply or disclosure of information by an individual person or public officer or private institution or civil organization which relates to the state of security in an area, place or work place and shall, in relation therewith implement any directive issued by the District Security Committee.

17. Imple­mentation of decisions and directives

(1)Every Regional Security Committee and District Security Committee, shall comply with any decision or directive issued by the immediate higher security committee.
(2)Every security committee shall implement every decision made or directive issued by the immediate higher Security Committee within such period as may be given and prepare a report and submit it to the higher security committee that made the decision or issued the directive.
