[Section 45]

1.

These Regulations may be cited as the Transport Licensing (Prescribed Conditions) (Public Carriers' Licences) Regulations.

The following conditions in relation to public carriers' licences are hereby prescribed for the purposes of paragraph (e) of subsection (2) of section 31 of the Transport Licensing Act—
(a)a condition that the holder of a public carrier's licence shall be bound to accept for carriage, and to carry, all goods offered to him for carriage, being goods which he is required to carry under his licence, by any person who has tendered the appropriate rates and charges for the carriage of the goods, unless—
(i)the goods tendered for carriage are livestock; or
(ii)the goods tendered for carriage are dangerous or offensive or are likely to cause damage to person or property; or
(iii)the goods tendered for carriage exceed the maximum weight or dimensions carried by such holder; or
(iv)the goods tendered for carriage are insufficiently or improperly packed; or
(v)the goods are tendered for carriage to a destination to which the operations of the holder do not extend; or
(vi)the value of the goods tendered for carriage exceeds the maximum value accepted the holder; or
(vii)facilities are not available for dealing with the goods tendered for carriage;
(b)a condition requiring the holder of a public carrier's licence to accept goods for delivery and to unload goods which have been carried at places specified by the licensing authority in the licence;
(c)a condition requiring the holder of a public carrier's licence to issue in such manner and form as the licensing authority may specify in the licence a tariff setting out all the rates and charges made for the carriage of goods by the holder and all the terms and conditions, including the conditions to which his licence is subject, relating to the carriage of goods by the holder, and to publicise such tariff and make it available for public inspection in such manner as the licensing authority may specify in the licence;
(d)a condition requiring the holder of a public carrier's licence to give notice to the public in such manner as the licensing authority may specify in the licence before making any alteration in the tariff issued by the holder;
(e)a condition requiring the holder of a public carrier's licence to carry goods, other than goods comprising bulk consignments of five tons or over, at the rates and in accordance with the terms and conditions as set forth in the current tariff issued by the holder.
