1. Citation

These Regulations may be cited as the Wildlife Conservation (Registration of Trophies) Regulations, and shall come into operation on the date of the commencement of the Wildlife Conservation Act1.1Cap. 283

2. Interpretation

For the purposes of these Regulations, "prescribed marking" means, in relation to a trophy produced for registration to a licensing officer having jurisdiction over any district or urban centre specified in the first column of the First Schedule to these Regulations, the marking prescribed in relation to such district or centre in the second column of the said Schedule and every such marking shall be affixed by causing the same to be indented or impressed on the trophy.

3. Funcctions of licensing officer

The licensing officer to whom any trophy is produced for registration, shall, if he is, after such enquiry as he may consider necessary, satisfied that such trophy was lawfully obtained–
(a)in the case of raw ivory or rhinoceros horn—
(i)weigh and mark the trophy with the prescribed marking and the appropriate serial number;
(ii)record the weight, mark, number, owner's name, date, licence details and any other relevant information in the register of trophies which shall be in the form prescribed in the Second Schedule to these Regulations;
(iii)issue in respect of the trophy a trophy certificate of registration in the form prescribed in the Third Schedule to these Regulations;
(iv)record the particulars of the trophy certificate of registration on the register of trophies as well as on the licence, permit or other authority under which the animal from which the trophy came was hunted or otherwise killed;
(b)in the case of raw hippopotamus teeth, animal tushes or bones—
(i)weigh all the pieces of each species together;
(ii)record the weight, number of pieces, owner's name, date, licence details and other relevant information on the official register of trophies;
(iii)issue in relation to all the pieces of each species so produced one trophy certificate of registration;
(iv)record the particulars of such trophy certificate of registration on the official register of trophies as well as on the relevant licence or permit;
(c)in the case of a raw skin, ear, foot, tail or any other raw part of any animal—
(i)issue for each of them a trophy certificate of registration and record the details of the certificate on the relevant licence;
(ii)record the particulars of the trophy certificate of registration and the relevant licence on the official register of trophies;
(d)in the case of a manufactured trophy–
(i)issue in respect thereof a trophy certificate of registration in the form prescribed in the Fourth Schedule to these Regulations;
(ii)assign the trophy a serial number and record the number on such trophy certificate of registration for manufactured trophy;
(iii)record on the trophy certificate of registration the particulars of any certificate of registration or other authority authorising possession of the raw trophy out of which the manufactured trophy was produced.

4. Fees

The fee specified on the prescribed form shall be payable in respect of a trophy certificate of registration to which the form relates.

5. Affixing of trophy label

(1)Every dealer of manufactured trophy who displays for sale or offers for sale any manufactured trophy shall affix on the manufactured trophy a label, clearly visible to any person looking at the manufactured trophy, giving particulars of the price for which the trophy is to be sold and the serial number of the trophy certificate of registration issued in respect of the trophy.
(2)Any person who contravenes any provision of this regulation commits an offence and on conviction to a fine not exceeding fifteen thousand shillings or to imprisonment for a term not exceeding three years or to both that fine and imprisonment.

6. Transfer of trophy to another person

(1)When the owner of any trophy to which section 65 of the Wildlife Conservation Act 2, proposes to transfer the trophy to any other person he shall produce the trophy certificate of registration issued in respect of the trophy to a licensing officer and apply for permission to transfer the trophy to which the certificate relates.2Cap. 283
(2)The licensing officer to whom a trophy certificate of registration is produced under subregulation (1) may, if he is satisfied that the proposed transaction is bona fide and not against the public interest authorise the transfer by endorsing on the certificate (in the space provided therefor) the name of the transferor and the name of the transferee and when the endorsement has been duly signed by the transferor, the transferee and the licensing officer and stamped with the official stamp, it shall constitute a transfer permit under section 65 of the Wildlife Conservation Act 3.3Cap. 283

7. Offences

Any person who fails to comply with any of the provisions of these Regulations or makes any false statement in any application or other document or to any authorised officer performing any function under the Act or any subsidiary legislation commits an offence and is liable on conviction to a fine not exceeding fifteen thousand shillings or to imprisonment for a term not exceeding three years or to both that fine and imprisonment.
