1. Citation

These Regulations may be cited as the Advocates (Admission and Practising Certificate) Regulations, 2015.

2. Fee for admission

The fee payable for the entry of an admitted person's name on the Roll under the provisions of subsection (4) of section 8 of the Act shall be—
(a)twenty thousand shillings for East African Citizens; and
(b)US Dollars one hundred or its equivalent in Tanzanian shillings for non East African Citizens.

3. Fee for practising certificate

The fee payable for a practising certificate issued to an advocate under the provisions of Part VI of the Act shall be—
(a)fifty thousand shillings for an advocate with less than five years practising experience; and
(b)one hundred thousand shillings for an advocate with five years practising experience and above.

4. Fee for temporary practising certificate

The fee payable for admission to practise as an advocate in any one case stipulated under subsection (2) of section 39 of the Act shall be—
(a)five hundred thousand shillings for each case, in the case of a person so admitted to practise before the Court of Appeal or any court or tribunal from which an appeal lies to the Court of Appeal; and
(b)four hundred thousand shillings for any other case.

5. Failure to renew a practising certificate

An advocate who fails to obtain a practising certificate within six months after the expiration of the last certificate issued to him shall, upon being granted leave to renew the certificate out of time, pay the fees for renewal of the certificate plus half that the amount as penalty for default:Provided that the Chief Justice may upon good cause being shown, waive the penalty.

6. Declaration forms

(1)The form of declaration to be made by an advocate who is applying for a practising certificate under Part VI of the Act and the form of such practising certificate shall be as set out in Form I and Form II in the Schedule to these Regulations.
(2)The declaration shall be attested by a Commissioner for Oaths to whom the declarant is personally known and the Commissioner for Oaths shall date and affix his stamp, name and signature on the declarant’s photograph attached thereto.

7. Revocation of GN No. 121 of 1955

The Advocates (Admission and Practising Certificate) Regulations are hereby revoked.
