High Court of Tanzania

This is the second level in the Judiciary justice delivery hierarchy. It has both appellate and original powers on civil and criminal matters. It also hears appeals from the Courts of Resident Magistrate, the District Courts, and the District Land and Housing Tribunals in exercise of their original, appellate and/or revisional jurisdiction. The High Court is divided into Zones and specialized Divisions.

High Court lacks revisional jurisdiction where proceedings originated in a Ward Tribunal and only later reached the Primary Court.
Civil procedure – jurisdiction of High Court – revision under s.79 CPC and Part III(C) MCA – applicability limited to matters originating in Primary Courts. Appeals – matters originating in Ward Tribunals appealed to Primary Courts do not "originate" in Primary Court for revisional jurisdiction. Constitutional challenges – must follow prescribed procedure under Basic Rights and Duties Enforcement Act; alternatively consider certiorari under Law Reform Act. Interpretation of "originate" in statutory context; limits on High Court's revisional jurisdiction.
