High Court of Tanzania

This is the second level in the Judiciary justice delivery hierarchy. It has both appellate and original powers on civil and criminal matters. It also hears appeals from the Courts of Resident Magistrate, the District Courts, and the District Land and Housing Tribunals in exercise of their original, appellate and/or revisional jurisdiction. The High Court is divided into Zones and specialized Divisions.

Failure to prove identity to link prior convictions bars their use in sentencing, but conviction and sentence were nevertheless upheld.
Criminal law – Evidence of identity – Prior convictions – Where identity is disputed, prosecution must produce certificate of fingerprint identification or other evidence before prior records may be used at sentencing; absence of such proof requires disregarding prior convictions.

Conviction for stealing by a court clerk upheld; sentencing irregularity cured by substituting minimum concurrent sentence.
Criminal law – theft by public servant – conviction upheld where clerk failed to account and absconded; Sentencing – Minimum Sentences Act 1963 – failure to impose statutory minimum on all applicable counts is irregular; appellate court may quash and substitute sentence to conform with statutory minima.
