High Court of Tanzania

This is the second level in the Judiciary justice delivery hierarchy. It has both appellate and original powers on civil and criminal matters. It also hears appeals from the Courts of Resident Magistrate, the District Courts, and the District Land and Housing Tribunals in exercise of their original, appellate and/or revisional jurisdiction. The High Court is divided into Zones and specialized Divisions.

Appeal dismissed: evidence upheld convicting the appellant for possession of suspected stolen property and bribing an agent.
* Criminal law – possession of property suspected to be stolen – presumption of stolen/unlawfully obtained property under s.312(1)(a) – accused's failure to rebut presumption. * Prevention of Corruption Act – corrupt transaction with an agent – payment as inducement to refrain from performing official duty – proof of movement and intent. * Evidence – credibility and demeanour – appellate deference to trial judge’s findings on witness reliability. * Pleading – technical mis‑citation of statute not fatal where particulars are clear and accused not prejudiced.
