High Court of Tanzania

This is the second level in the Judiciary justice delivery hierarchy. It has both appellate and original powers on civil and criminal matters. It also hears appeals from the Courts of Resident Magistrate, the District Courts, and the District Land and Housing Tribunals in exercise of their original, appellate and/or revisional jurisdiction. The High Court is divided into Zones and specialized Divisions.

First accused acquitted for lack of common intent; second convicted of manslaughter for an unintentional fatal blow during a drunken quarrel.
Criminal law – Homicide: distinction between murder and manslaughter; requirement of malice aforethought for murder; effect of intoxication and trivial provocation on intent. Criminal law – Common intention: necessity of evidence to show presence, participation or shared intent for joint liability. Evidence – Admission by accused of striking fatal blow as proof of causation but not necessarily of murderous intent.
