High Court of Tanzania

This is the second level in the Judiciary justice delivery hierarchy. It has both appellate and original powers on civil and criminal matters. It also hears appeals from the Courts of Resident Magistrate, the District Courts, and the District Land and Housing Tribunals in exercise of their original, appellate and/or revisional jurisdiction. The High Court is divided into Zones and specialized Divisions.

The applicants’ High Court interim application filed while a related lower‑court suit remained pending was an abuse of process and struck out.
Civil procedure – Preliminary objection – res sub judice not a proper PO where it is not pleaded and requires evidence; remedy is stay, not disposal. Interim reliefs – High Court may grant interim/Mareva‑type orders under s.2(3) JALA even where CPC is silent. Government Proceedings Act – 90‑day notice does not, per se, bar interim injunctions. Overriding objective – minor title defects not fatal if no prejudice. Abuse of process – filing parallel proceedings without formal withdrawal is incompetent and liable to be struck out.
