High Court Land Division

High Court Land  Division was established as a result of the land reforms which were implemented by the Land Act 1999. Until 2010, the Land Court had exclusive jurisdiction to determine land disputes relating to land with a pecuniary value of TZS 50,000 or more.

A district land tribunal lacked jurisdiction over a dispute concerning registered land, so its decision was quashed.
Land law – jurisdiction – dispute concerning registered land held under a certificate of title falls within High Court (Land Division) jurisdiction under s.37 of the Land Disputes Courts Act, not District Land and Housing Tribunal jurisdiction. Procedural – ex parte judgment and service complaints unnecessary to decide once tribunal lacks jurisdiction. Relief – proceedings and decisions of an incompetent tribunal are quashed and orders set aside.
